In this session Chris Mercer will delve into more than 30 years of experience presenting complex valuation and damages issues to a non-financial audience, such as judges and juries. One of the key ideas of effective communication is the KISS principle, or “keep it simple, stupid.” The question is, how can we do that? Mr. Mercer provides the techniques and templates necessary to communicate your position, and your opponent’s position, in such a way that non-financial people can hone in on and understand the most important information and why it’s important.

  • Key philosophical concepts and ideas to frame your thinking about communications with judges and juries.
  • Examples of effective diagrams, illustrations, and examples in PowerPoint that convey complex ideas simply
  • Use of flip charts or white boards to convey ideas “in the moment” during testimony in court
  • An effective technique to compare your valuation or damages analysis with that of your opponent to illustrate the reasonableness of your conclusions and the unreasonableness of hers (and how not to personalize)
  • What to avoid when you are testifying in court
